A jaywalker made the fatal mistake of stepping in front of a moving police car last night. Our thoughts are with the officer knowing the wringer he is about to be pulled through.

Lots of questions to be answered by TSU.
Was the officer speeding?
Were the lights and siren activated?
Is this related to the 10-80 involving a truck from the Starlight 58?
Was there a cross walk near the scene of the accident?
My condolences to the family of the deceased and prayers for the officer and all involved....there but for the grace of God, we could probably all be in his or her boots.
Maybe I'm getting "soft" as the years go by. But I would like to add our prayers and thoughts are also with the family of the man/woman who died as a result of being struck by the officer. I hope the officer was doing everything right because a lawsuit is sure to follow if they werent.
I always wondered WHEN this was going to happen! Saw it all the time on Memorial Drive in Center going towards South...idiots in all black clothes walking in middle of street or darting out into the road...just a matter of time! Good luck to that officer!
No lights, no siren, "70-80mph" down Memorial Dr? Hopefully this Officer doesnt get "Hambied"
Thoughts and prayers with all involved...the officer, the deceased and their families...All will and are feeling the impact of this tragedy.
That being said, questions remain for TSU to investigate and to answer AND for us to think about and consider as we are driving the streets of Dekalb:
Was the officer speeding?
Was the deceased jaywalking in an area with crosswalks?
If speeding, was the officer running blues lights and siren?
Was this related to the 10-80 involving the suspect vehicle from the 58 at the Starlight Drive-In?
Did the black box keep the data or was the data gathered prior to the accident lost because the system is on a continuous loop?
Does the officer have the FOP Legal Package or the PBA?
If the officer wasnt within regulations he may as well go ahead and resign
Would anyone like to wager how badly the officer is going to get burned, regardless of fault, in an attempt to assuage the feelings of the public? If he is not at fault, how soon before the DA charges him...since it is an election year?
“Due Regard is based on circumstances.” In judging “DUE REGARD, the principal criteria used is: Was there “enough” notice of approach to allow other motorists and pedestrians to clear a path and protect themselves? If you do not give notice of your approach until a collision is inevitable, you have probably not satisfied the principle of due regard for the safety of others.
In determining whether an emergency vehicle operator was exercising due regard in the use of signaling equipment, for example, the courts will consider, the following points:
A. Was it reasonably necessary to use the signaling equipment, given the circumstances?
B. Was the signaling equipment actually used?
C. Was the signal audible and/or visible to motorists and pedestrians?
A widely accepted way of determining “due regard” is: “A reasonably careful man performing similar duties and under the same circumstances, would act in the same manner.”
In the words of the Great Ken C.
Best of luck mates. This has been the mindset of the Command Staff at Tucker for some time now. Looks like we may have the first casualty of our new pursuit policy, oh wait we don’t have a new policy.

Just saw Ch. 2 report "A dozen Officer's under investigation". Yep you guessed it Dekalb County. Wiz Miller's response; I had no idea we had this many officers under investigation...HAAAA YEA YOU WOULD HAVE TO HAVE AN ACTIVE ROLE IN RUNNING THE DEPARTMENT AND ACTUALLY SHOW UP AT THE OFFICE TO HAVE ACCESS TO THAT TYPE OF INFORMATION. Hey Wiz your lack of knowledge SPEAKS volumes....Resign dude you too are an embarrassment, to our once great department.
The "Great Ken C" ? Please.
Listen, I am a citizen who has this question.
An Officer is trying to do his job. It's dark out, and he doesn't have lights flashing?, but has headlights on. Maybe lights should have been flashing, maybe not, I don't know, but would that really have prevented the accident???
Citizen CHOOSES to disobey the law by walking out into the street, outside of a crosswalk.
I'm so sorry the pedestrian was killed, but what the heck happened to people taking responsibility for their own selves?
Why would the officer be held responsible? Or, liable. I don't know of any other profession where the standards are so high.
God Bless all of you - thank you for what you do. And I hope the Officer will be ok through this.
"I'm so sorry the pedestrian was killed, but what the heck happened to people taking responsibility for their own selves?"
That went out the window a long time ago. Get with the program, the government is responsible for everything everyone does these days. It doesn't matter if they do something stupid with their own free will or not. It's no longer about personal responsibility, but who you can blame and sue.
Oh I see how it is now, you guys and girls only want to jump on the ones that have held you in check. This officer will be tried in the court of public opion first, then by our P/O/S of a DA. Hw made a mistake, not unlike the ones we made at his age. I guess you can blame Bolton or Wiz if you want but I don't see it like that from inside my glass house. I can't aford to throw any stones.
Best of luck to you my brother in blue.
Coop is one of the best officers and best guys out there. Works hard and is a quiet guy, he'll show up from miles away to check on you and back you. The "victim" had been J1'd about a half dozen times just in Dekalb. He was too stupid to look before walking into traffic and now look what we got- too bad we don't work for a county that supports their officers...we're here for you Coop.
Let me start off by saying this.
This blog is not the forum for this kind of rhetoric.
The Blog Master needs to be very selective in what comments are posted in regards to this incident. The primary reason is not only are fellow officers following the comments but so is the public, the media, the pedestrian's family and their attorney's. I ask that everyone be mindful of what you decide to post or comment and refrain from making suggestive comments about the rumors or potential facts that may be common knowledge about this accident. These comments can be and most likely will be used against the officer. I am very sure that the family of the pedestrian have retained attorney's and will be looking for anything that could be used to build their case and this blog provides plenty of unintentional ammunition. You guys need to be smarter than this and remember this could very well be any one of you....Godspeed
BlogMaster please use judgement before posting comments on this incident....good medicine sometimes is a very bitter pill to swallow....
