Taser Death Prompts Lawsuit....Blah Blah Blah

Nice how the article leaves out that this man weighed about 400 pounds and was all coked up.

Surely the reporter doesn't have an agenda.

The media has managed to get all law enforcement pissed off when an incident such as this happens. The media has a tendency to turn things around, and very rarely ever proof reads their own stories.

The media 99.99% of the time will always side with the victim, rather than finding out the truth. They do this to sell the time on the radio or tv, spce in the newspapers, magazines, or even online. Most of the media is as liberal as the President.

The AJC is one rag that DOESN'T LIKE POLICE OR ANY LAW ENFORCEMENT.

The only good thing that the AJC is good for is lining trash cans in place of bags and nothing else!

Yet ANOTHER reason no one wants to work for DKPD any longer. Imagine being subject to a jury of your "PEERS" In Dekalb County.

AJC is trying to clutch at straws because they're basically on their last legs. I really hate when reporters and loudmouths jump into something and start talking about it like they wre there. There are too many "experts" and not enough people with real world knowledge these days.

I would ask for a change of venue there is no way they will get a fair trial when everone on the jury probley had a encounter with Dekalb Police. I wish the best for these Officers. I wonder what is the EMS policy for people refusing treatment. If they think it is life threatening can someone refuse allowing EMS to go 10-8 or can they force someone to go. Based on the AJC story and we all know that is not all fact I am sure I would have not used the taser. If the asshole wants to die let him we can't force someone to go to the hospital if they want to kill themself. I know one thing keep in mind they were ordered to use the taser. Officers keep in mind you don't have to follow those orders if you think it is not a valid order. We all know you can not use that as a defense when it goes to trial.

Don't blame the AJC for quoting what they read in the lawsuit. That was what I saw on their news story. Blame te lawyer for what was written in that lawsuit, not the New Paper!

Since they are going with the notion that the Taser killed the guy, they should also sue eating utensil companies for making him 400 lbs.

Dont get upset by the news. Their job is to sell advertisement. That is all. They pick and choose which stories they are going to publish based upon those stories they bring the highest ratings and allow for the highest advertisement prices. That victim was no saint. These officers were cleared by IA. If there was anything to this charge the FBI and DOJ would be involved. They are not invoved. This is a case of a siler and jonap type attorneys grasping at straws to make money.
But the article and tv news account were humorous.

No, I don't blame the AJC for quoting from the lawsuit - but I do blame them for the title of the story "Taser Killing...". "Killing", really AJC? That certainly implies intent, and the use of the Taser resulted in the subject's death - neither which has been proven. Sounds like the AJC not only has an agenda, but has passed judgement on the case.

To anon 8:51. Basically any adult that is conscious and aware of what is going on can refuse EMS transportation and/or treatment. If the person has a bullet in their chest and they're told they will die in 10 minutes they can refuse EMS services. They must sign our little computer that advises them they may die and will not hold the county liable. Also, a witness signs as well verifying the patient was told what may happen to them. Usually we have PD sign as a witness such as an accident or assault.

If the patient is intoxicated or otherwise impaired by drugs or a medical condition then they cannot refuse treatment. If it is medical in nature like their sugar is low and we are able to bring it up to where they can consent and understand what is going on they won't be transported. Otherwise if they are not aware what is happening they are going to the hospital.

The only time it gets tricky is when there are minors involved. Hope that helps.

The AJC and the news stations are so one sided in their stories. You would think the officers just went up to an innocent man and just tasered him. Look at the facts, and don't trust what you read in the paper or hear on the news. I learned that a long time ago.

Don't know the facts, but these questioned will be asked. How many officers were on scene during the incident and why they couldn't restrain him. They will also question the use of force (hands, batton, OC, then taser) and why it wasn't followed like policy states. One thing to remember also, constitutional law over rules dept policy. Policy can say all it wants, if it's a violation of his 4th Amendment they will also be sued.

Anon 6:41 p m. You make the statement that it wasn't like the "police just walked up to an innocent man & tased him" .What type of crime was this man committing that made him "guilty"? Refusing medical transport? If you knew anything about seizures/epilepsy then you would know all about combativeness in seizure patients. There is a time, place & circumstances requiring tasing a person but does refusing treat/transport to a medical facility after having a seizure & being combative make a person guilty of a crime? According to reports (not AJC either) the man had no weapons on his person let alone one in his hand threatening to shoot, stab or otherwise kill a medic or police officer Maybe the fact that the guy was morbidly obese made him guilty of a crime, thus, deserved to receive 200,000 volts of electricity.

No, the police didn't just walk up on a random guy and tazer him. Their assistance was requested by EMS!! You're obviously a family member looking for money! Don't you think EMS knows the difference between someone just having a seizure, thrashing around and someone being violent towards them?? EMS doesn't call PD because someone is too fat and heavy to handle, like this tub o'lard, or if someone is just refusing treatment. They only call PD when someone is being combative! Combative means VIOLENT! You want to blame the police when you should be blaming his parents for not raising him with better morals and with better eating habits!

I saw the toxicology reports the medical examiner did. They tested for 250 different drugs (really!). Everything came back negative except for PRIOR use of pot. Also read the Medical Examiner's Report and Investigation. Seems that everything in the law suit that was filed was from the Investigator's Report and the Policy Manual. Also read where the guy did NOT commit a crime. Just wondering...

It wasn't the tazer that killed him, it was the year of twinkies and honey buns! The family should be ashamed of themevles. They did a shitty job raising him. Now they want to get paid because of it.
